Over his nearly 30 years of litigation practice, David has been involved in hundreds of formal Mediations, as both Plaintiff’s counsel and as Defence counsel in a variety of practice areas.  These practice areas include bodily injury; commercial and contract disputes; and employment and disability cases.  In addition to his many years of experience with Mediation, conflict resolution and Alternate Dispute Resolution, David also attended and graduated from the internationally recognised Straus Institute for Dispute Resolution at Pepperdine School of Law in Malibu, California, to receive his formal Mediation / conflict resolution accreditation, prior to the offering of his services as a Mediator.

David brings a wealth of experience in dispute resolution a deep understanding of both the legal intricacies and the human dynamics at play in litigated disputes.  David brings a unique pragmatic perspective to alternative dispute resolution resulting in the best possible chance of resolution.  This approach, coupled with David’s energy, enthusiasm and relentless dedication to fostering amicable resolutions of disputed claims, make David a very effective Mediator.  David approaches each case with a fresh perspective and an unwavering commitment to assisting the parties to achieving equitable outcomes. David’s extensive trial experience (as both Plaintiff’s counsel and defence counsel) in a breadth of practice areas over decades of practice, provided David with the insight needed to assist the parties in navigating even the most complex, acrimonious and challenging of disputes.

In terms of his practice background, David launched the Whitelaw Twining Injury (WT-Injury) practice when he joined us in 2002, building on an already successful career as a trial lawyer acting on behalf of Plaintiff’s and Defendants in a variety of practice areas. Since then, he has expanded our list of bodily injury clients from less than ten to over 300. With an impressive and proven track record for results, David has achieved a remarkable total of over $100 million paid out to injured clients in trial awards or settlements, just in the last decade alone.

For nearly 30 years of practice, David has handled everything from chronic myofascial / musculoskeletal injury claims and psychiatric / psychological injury claims, to catastrophic injury claims and everything between. With extensive experience handling complex claims such as spinal cord injuries, traumatic brain injury claims and complex trauma-related psychiatric conditions, David draws upon his decades of experience in these often complicated and challenging cases to ensure every client’s claims are thoroughly presented to obtain a successful legal conclusion.

David’s reputation and a fierce and unrelenting advocate for his clients through his extensive trial experience and impressive trial results has resulted in David receiving professional recognition as the recipient of many awards of distinction, as well as being frequently retained and consulted by lawyers outside of our firm on complex cases, seeking David’s technical assistance and file handling strategy advice.

David frequently appears as trial and appeal counsel for injured parties in both the Supreme Court of British Columbia and the British Columbia Court of Appeal. He has also appeared as trial counsel in the Federal Court of Canada and the Federal Court of Appeal. With nearly three decades of experience and a thriving team of legal professionals behind him, David now spends a large part of his practice mentoring, strategizing and consulting with other lawyers on his Team and with within the firm more generally.

As a trained Mediator, David also has a special interest in the effective use of alternate dispute resolution to resolve disputes, as well as the critical use of medical-legal and other critical experts in the handling of bodily injury claims. David has published many articles in numerous important bodily injury practice matters and has also presented as an invited guest Moot Court Judge and lecturer at legal and other professional conferences within his area of practice.
