David Fung

Profile

David joined Whitelaw Twining as a Summer Student in 2017 and has since articled with the Firm before becoming an Associate in 2019. David’s practice encompasses local and multi-jurisdictional disputes focused in shipping, transportation, marine insurance, and non-marine property damage. In his shipping, transportation, and marine practice, David has acted for a spectrum of freight forwarders, operators, charterers, cargo interests, vessel owners, commodity traders, and insurers in contentious matters involving allisions and collisions, fumigation, tankers, liquid and other bulk cargoes, metals, contamination claims, trade letters of credit, sale of goods, and issues arising from salvage. He has also assisted and advised clients in respect of coverage, marina fires, and aviation repair disputes.

In his non-marine property damage practice, David often advances subrogated matters on behalf of insurance clients and has experience working with a range of insureds, from homeowners, small, and local businesses to large national and multi-national companies. He understands that successfully advancing a subrogated claim is multi-faceted, and David enjoys bringing together a viable legal case with the cooperation of the insured while balancing financial risk and recovery for the insurance client. As a result, David has a strong record in resolving tort actions arising from fires, floods, and product liability.

David has represented clients in an array of disputes, including complex multi-party litigation, in British Columbia Provincial and Supreme Courts, in the Federal Court, and in international arbitration. His deep experience working with clients of varying scale makes him an effective advocate and someone who understands his clients’ needs. David’s creative strategies, practical approach, and forward-thinking enable him to save his clients time and money while obtaining results that align with their goals.

David is a Co-Chair of the Firm’s Diversity, Equity, and Inclusion Committee, an Executive of the Canadian Bar Association (BC) Maritime Law Subsection, and has served on the Board of Directors of the Federation of Asian Canadian Lawyers (BC). He worked in business development in the technology sector before becoming a lawyer. As well, he is passionate about exploring new restaurants and travel destinations, and is an avid follower of tennis and soccer. David also loves spending time with his wife and twin boys, the latter of whom have transformed his idea of what a “healthy” sleep schedule is.
