Our Cyber, Privacy & Data Protection Group are national leaders in incident response, guiding public and private sector organizations through crises while minimizing expense, reputational risks, and legal liability exposure. Our expertise encompasses pre-incident preparedness work, where we identify risks and develop emergency response plans and long-term strategies that protect our clients. We are focused on helping clients to deliver meaningful, high-quality operational outcomes for data protection and cyber security, not ‘ivory tower’ legal advice or ‘compliance for compliance sake’. Our lawyers are also top litigators with the specialized experience and resources needed to bring urgent court proceedings anywhere in Canada to recover funds lost in EFTs and other types of payment fraud and to defend our clients at trial against all manner of cyber, privacy and data related claims.
We are routinely retained for the following services:
Breach Coach
We act as a breach coach, providing round-the-clock strategic legal advice when cyber events occur, and guide the company’s response to minimize business impacts, reputational harm, liability risks, and compliance with regulatory requirements, including notification and reporting obligations. As a breach coach, we coordinate with experts and manage responses to all manners of cyber and privacy events. We also provide strategic guidance to clients through every step of high-profile incidents, media coverage and reputational risk considerations, including liaising with PR experts.
Litigation: Funds Transfer Fraud Recovery and Defence Counsel
We are leading trial and appellate counsel, and, with our cyber and privacy expertise, we are ideally positioned to bring urgent court proceedings to clawback funds lost in payment fraud schemes, frequently associated with business email compromise incidents. We also defend third party cyber and privacy related litigation, including class actions and complaints before administrative tribunals.
Preparedness Work
Having acted on thousands of cybersecurity and breach of privacy incidents, including ransomware, business email compromise, funds transfer fraud, DDoS, bug bounty hunters, rogue employee/employee errors and other network compromises, we know how to prepare for them. We assist clients to develop bespoke incident response plans and playbooks, data-retention and management policies, vendor service level agreements and will test them all in realistic table-top exercises. We can also work with clients’ vendor procurement teams to establish relationships and onboard key vendors you will need in the event of a breach.
Privacy Regulatory Guidance and Advice
Not every privacy issue starts with a cyber event. Our team of data and privacy law experts will always be available to address any privacy concerns your team may have. In every case, our primary goal is to preserve and enhance a client’s brand reputation and to minimize the time and expense our clients spend dealing with these issues. We advise on the handling, use and security of data and the digital environment, including the achievement of ethical outcomes. We regularly advise the boards and c-suites of Canada’s leading private sector organizations on corporate good governance related to privacy and data security to support effective executive decision-making.
